Terms of purchase

These General Terms and Conditions of Contract (hereinafter, General Terms) govern the sale of the products offered by LD4X4 S.L. in the catalogue available on its website https://www.landclassics.com.

The General Terms bind LD4X4 S.L. and the buyer (Customer), granting them a series of rights and obligations, from the moment the latter places and accepts an order through this website. They are binding on both parties and must be known by both, so accepting them is essential in order to place an order. The Customer should therefore read these terms carefully.

The headings of the various clauses are for information only and shall not affect, qualify or extend the interpretation of the General Terms.

These General Terms are governed by the legislation in force.

Contact: for any communication required between LD4X4 S.L. and the Customer, the Customer should contact Customer Service by email at info@landclassics.com, or by post addressed to the Customer Service Department of LD4X4 S.L. at the postal address above.

For all communications relating to their purchases, the Customer expressly accepts email as a valid means of sending such communications.

Customer

A Customer is any user of the website https://www.landclassics.com who places an order and accepts it at the time it is placed.

To place an order, the Customer must provide the following information: full name or company name, address, postcode, contact phone number and contact email. If an invoice is required in the name of a company, its tax ID / VAT number must also be provided.

This information will be processed in accordance with these General Terms and the Privacy Policy of this site.

Purpose of the contract

The purpose of this contract is the sale of spare parts and accessories for Land Rover vehicles — in particular the Range Rover Classic, Discovery I, Discovery II and Defender — offered by LD4X4 S.L. on this website.

Offer

Each product has a page showing its description and its sale price in euros, VAT included.

The final purchase price of a product or its shipping costs may vary depending on the destination region, as costs and applicable taxes may differ according to the geographical area of delivery. In any case, as the Customer enters the delivery address, the website will show the exact price before the order is confirmed.

In most cases, a product page will include a photograph of the product, together with its technical specifications and the vehicles it fits.

Sales to customers in mainland Spain and the Balearic Islands are invoiced with Spanish VAT; sales to the Canary Islands, Ceuta and Melilla are invoiced without Spanish VAT (see Shipping Policy). Sales to private individuals in other European Union countries are invoiced with the VAT of the destination country, under the One-Stop Shop (OSS) scheme. Sales to businesses in other European Union countries that provide a valid intra-Community VAT number are invoiced without VAT, under the reverse-charge mechanism. Sales to destinations outside the European Union are invoiced without VAT; any import taxes and duties are payable by the Customer. LD4X4 S.L. states that its website is aimed at sales both in Spain and abroad.

Acceptance of the offer

Acceptance takes place when the Customer gives express consent to the order placed, after accepting the General Terms. It is completed by clicking the payment confirmation button on the order screen.

By confirming the order, the Customer enters into a contract for the purchase of products with LD4X4 S.L., acquiring the rights and obligations set out in the applicable legislation and in these general terms of contract.

After placing the order, the Customer will receive a confirmation email. If any aspect of the order needs clarifying, LD4X4 S.L. will contact the Customer within a maximum of 48 hours.

The invoice for the purchase will be sent to the Customer.

Payment of orders

The product(s) will be reserved once payment has been made.

If the product is no longer in stock at that time, we will contact you to explain the situation and tell you when the product will next be available or, where appropriate, to cancel the order and refund the corresponding amount.

LD4X4 S.L. offers the Customer payment by credit or debit card (Visa, Mastercard, Maestro, American Express) and the other payment methods shown on the payment screen at any given time (for example, Apple Pay or Google Pay). LD4X4 S.L. may add or remove payment methods at any time. The Customer will select the chosen payment method from those available when making the purchase.

Payment is made when the order is placed, through a secure payment gateway. The system will automatically calculate the associated shipping costs, which will be shown before the order is accepted. Any undue or fraudulent charge must be notified as soon as possible.

Delivery times

Delivery times depend on the availability of the product or products in the order. In-stock products are delivered within 24/48 working hours and products on order within 7-8 working days, once payment has been confirmed (times for mainland Spain; see the Shipping Policy for other destinations). These times may change during holiday periods or due to circumstances beyond LD4X4 S.L.'s control. Please also see our Shipping Policy.

We do not ship to PO boxes.

Late delivery shall not give rise to any compensation and shall only entitle the Customer to cancel the order in the circumstances described in these terms. Any late-delivery penalty clause introduced by the Customer in their order shall have no effect.

For each order, LD4X4 S.L. will try to provide as much information as possible about product availability.

Deliveries will be made by a courier company to the delivery address given in the order's shipping details. Changing this address afterwards may generate costs payable by the Customer and may affect delivery.

Record of transactions

Transactions between LD4X4 S.L. and the Customer will be filed by LD4X4 S.L. and will be accessible.

Withdrawal, returns and warranty

The right of withdrawal, returns and product warranty are governed by our Returns and Warranty Policy, which forms part of these General Terms.

Complaints

In accordance with current legislation, complaint forms are available to our Customers at the company's offices. You can also send any complaint to info@landclassics.com or by post to the address given in these General Terms. If you are a consumer, you may also contact the consumer affairs services of your region or the Consumer Arbitration Boards.

Customer obligations

• To read these General Terms before accepting the order.
• To comply with the General Terms once the order has been accepted.
• To comply with the Privacy Policy.
• To pay the agreed prices when placing the order.

Obligations of LD4X4 S.L.

Where the goods ordered can be delivered under the conditions agreed with the Customer, to deliver the product in good condition to the agreed delivery address.

Customer rights

• Where products are received, to receive them under the agreed conditions and in perfect condition.
• To cancel the order in the cases set out in these General Terms.

Rights of LD4X4 S.L.

• To receive payment for orders.
• To change the prices of its products on its website.
• To change product delivery times according to availability.
• To cancel orders for non-payment by the Customer.
• To close the website without prior notice.

Notices

For the purposes of notices, requests and documents of any kind arising from this contract, the address of LD4X4 S.L. shall be the one stated in these General Terms.

Validity of the clauses

If any clause of this contract, or any part of it, is declared invalid or unenforceable, the remaining clauses or parts shall remain valid and in force.

Applicable regulations

These General Terms are governed by current Spanish legislation and, in particular, by the Civil Code, Royal Legislative Decree 1/2007 of 16 November approving the consolidated text of the General Law for the Protection of Consumers and Users, Law 7/1998 of 13 April on General Contract Terms, Law 7/1996 of 15 January on Retail Trade, Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and their implementing regulations.

Governing law and jurisdiction

These Terms are governed by Spanish law. Unless expressly prohibited by law (in particular, where the Customer is a consumer, in which case the courts of their place of residence shall have jurisdiction), for the resolution of any dispute arising from these General Terms relating to the purchase of products or from the Privacy Policy, the parties by mutual agreement submit to the jurisdiction of the Courts of Vitoria-Gasteiz, expressly waiving any other jurisdiction that may apply.

Data protection

Regarding the processing of the personal data you provide, or any other data arising from the order, we inform you that they will be included in the data processing system owned by and under the responsibility of LD4X4 S.L., with registered office at C/ Zumabide 2, 01006 Vitoria-Gasteiz (Álava) and tax ID B21971429, for the purpose of providing our services and for our internal management.
